Terms of Service

These Terms of Service govern your use of Patrivo. By accessing or using our platform, you agree to be bound by these terms.

1. General Provisions

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Patrivo ("we", "us", "our"), operated by Wydler Digital, a company organized under the laws of Switzerland, with its registered office at Clos-de-Bonané 46, 1565 Vallon, Switzerland.

These Terms are governed by Swiss law, in particular the Swiss Code of Obligations (CO), the Federal Act on Data Protection (FADP/nDSG), and the Federal Act against Unfair Competition (UCA/UWG).

By creating an account or using any part of our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use our services.

2. Description of Services

Patrivo is a personal finance management platform that allows users to track expenses, manage budgets, set savings goals, and visualize their financial data through a customizable dashboard.

We reserve the right to modify, suspend, or discontinue any feature of the service at any time, with reasonable prior notice where practicable. Free features may be changed without notice. Changes to paid features will be communicated at least 30 days in advance.

3. Account Registration & Eligibility

To use Patrivo, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must be at least 16 years of age to create an account, in accordance with the Swiss Federal Act on Data Protection (Art. 30 para. 2 nDSG). If you are between 16 and 18, you confirm that you have parental or legal guardian consent.

You must notify us immediately of any unauthorized use of your account or any other security breach. We are not liable for losses arising from unauthorized use of your account.

4. User Obligations

You agree to:

  • Use the service only for lawful purposes and in accordance with these Terms.
  • Provide accurate, current, and complete information when creating and maintaining your account.
  • Not attempt to gain unauthorized access to any part of the service, other accounts, or computer systems.
  • Not use automated means (bots, scrapers) to access the service without our prior written consent.
  • Not reverse-engineer, decompile, or disassemble any part of the service.
  • Not use the service in a way that could damage, disable, or impair the service or interfere with other users.

5. Intellectual Property

All content, features, and functionality of Patrivo — including but not limited to text, graphics, logos, icons, software, and design — are owned by Patrivo or its licensors and are protected by Swiss and international intellectual property laws.

You retain ownership of the financial data you input into Patrivo. By using the service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the service to you.

6. Data Protection & Privacy

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP/nDSG) and, where applicable, the EU General Data Protection Regulation (GDPR).

Your rights under Swiss data protection law include:

  • Right of access — You may request information about what personal data we hold about you (Art. 25 nDSG).
  • Right to rectification — You may request correction of inaccurate data.
  • Right to deletion — You may request deletion of your personal data, subject to legal retention obligations.
  • Right to data portability — You may request your data in a commonly used, machine-readable format (Art. 28 nDSG).

7. Pricing & Payments

Patrivo offers both free and paid subscription plans. All prices are displayed in Swiss Francs (CHF) and include applicable taxes unless stated otherwise.

Paid subscriptions are billed on a recurring basis (monthly or annually). You authorize us to charge your chosen payment method at the beginning of each billing cycle.

Under Swiss law, there is no statutory right of withdrawal for contracts concluded online (Art. 40a et seq. CO applies to doorstep transactions only). No right of withdrawal or refund applies to subscriptions purchased through the platform.

We reserve the right to change pricing with at least 30 days prior notice. Continued use of the paid service after a price change constitutes acceptance of the new pricing.

8. Limitation of Liability

Patrivo is a financial tracking and planning tool. We do not provide financial advice, investment recommendations, or tax guidance. Any financial decisions you make based on information displayed in Patrivo are your sole responsibility.

To the maximum extent permitted by Swiss law (Art. 100 CO), our liability is limited as follows:

  • We are not liable for indirect, incidental, special, or consequential damages.
  • We are not liable for data loss resulting from circumstances beyond our reasonable control.
  • Our total aggregate liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
  • Nothing in these Terms excludes liability for intentional misconduct or gross negligence (Art. 100 para. 1 CO).

The service is provided "as is" and "as available" without warranties of any kind, except as expressly stated in these Terms or required by mandatory Swiss law.

9. Termination

You may terminate your account at any time by deleting it through your account settings. Upon termination, your right to use the service ceases immediately.

We may suspend or terminate your account if you violate these Terms, with reasonable notice where practicable. In cases of serious violations (e.g., fraud, unauthorized access), we may terminate your account immediately without prior notice.

Upon termination, we will delete your personal data within 30 days, except where retention is required by Swiss law (e.g., accounting obligations under Art. 958f CO).

10. Modifications to These Terms

We may update these Terms from time to time. Material changes will be communicated to you via email or through a notice on our platform at least 30 days before they take effect.

If you do not agree with the revised Terms, you may terminate your account before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict of laws provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts at the registered office of Wydler Digital in Vallon (FR), Switzerland, subject to mandatory statutory provisions granting jurisdiction to the courts at your place of domicile (Art. 32 CPC).

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the intended economic purpose.
